These Terms of Service govern your use of hudsonkayaks.com and any reservation, rental, tour, lesson, event, gift card, or other service offered by Hudson Kayaks LLC ("Hudson Kayaks," "we," "us," or "our").

Acceptance of Terms

By accessing hudsonkayaks.com, making a reservation, purchasing a rental, tour, lesson, event, gift card, or other service, or participating in an activity operated by Hudson Kayaks LLC, you agree to these Terms of Service, our Privacy Policy, and any waiver or safety rules applicable to the activity.

The person making the reservation represents that they are at least 18 years old, are authorized to make the reservation, and are responsible for communicating these terms to everyone in their group.

Reservations and Equipment Held

Reservations are made for specific equipment, dates, times, and durations. Once a reservation is confirmed, Hudson Kayaks removes the reserved equipment from availability and holds it specifically for that customer or group.

Charges are based on the equipment reserved, not the number of people who ultimately attend or the equipment ultimately used.

If fewer participants arrive, a participant changes plans, or any reserved equipment is not used, the unused portion is not eligible for a refund. Hudson Kayaks may, at its discretion, issue store credit for unused equipment if the customer provides notice before the reservation begins.

Store credit does not expire and may be applied toward a future reservation, subject to availability and current pricing.

Deposits and Payments

A deposit or full payment may be required to hold a reservation. A reservation is not confirmed until the required payment has been successfully processed and confirmation has been issued.

Any remaining balance must be paid before equipment is released.

Cancellations received at least 48 hours before the original reservation start time are eligible for a full refund, including any deposit paid, less any clearly disclosed booking or processing fee. See "Cancellation Policy" below.

Customers authorize Hudson Kayaks and its payment processors to charge the amounts shown during checkout. Customers are responsible for reviewing the reservation date, start time, duration, equipment quantity, and total price before submitting payment.

Cancellation Policy

Cancellations received at least 48 hours before the original reservation start time are eligible for a full refund, less any clearly disclosed booking or processing fee.

A customer who contacts Hudson Kayaks less than 48 hours before the reservation, but no later than one hour before the scheduled start time, may request one of the following:

• Reschedule the reservation, subject to availability.
• Receive store credit for a future reservation.

Refunds are not available for cancellations made less than 48 hours before the reservation.

Rescheduled reservations and reservations paid for using store credit are final and are not eligible for refunds.

Requests must be submitted to the Hudson Kayaks office by email, phone, text message, or another authorized communication channel. A request is not considered received until Hudson Kayaks confirms receipt.

No-Shows and Partial No-Shows

If a customer or any portion of the customer's group does not appear for the reservation and Hudson Kayaks did not receive proper notice before the applicable deadline, no refund, rescheduling, or store credit will be provided for the absent participants or unused equipment.

This policy applies whether the entire group is absent or only part of the group fails to attend.

Hudson Kayaks reserves equipment specifically for each reservation and may be unable to rent that equipment to another customer when a group does not arrive as booked.

Reservation Changes

Reductions requested less than 48 hours before the reservation are not refundable. Hudson Kayaks may issue store credit at its discretion when notice is received at least one hour before the reservation.

Changes are subject to availability and may result in additional charges.

Once the customer has arrived or the scheduled start time has passed, on-site staff are not authorized to change, cancel, refund, or reschedule the reservation unless management has provided specific approval.

Weather Policy

Hudson Kayaks monitors current conditions and makes all final safety decisions regarding whether paddling activities will operate.

Customers should assume the reservation is operating unless Hudson Kayaks directly communicates a cancellation.

Weather forecasts alone do not automatically cancel a reservation. Activities may continue during light rain, cloudy weather, cooler temperatures, or other conditions that Hudson Kayaks determines are safe.

Unsafe conditions may include lightning, thunder, high winds, strong currents, significant wave action, flooding, poor visibility, government restrictions, marine warnings, or any other condition Hudson Kayaks determines may present a safety risk.

If Hudson Kayaks cancels an activity because of weather or unsafe conditions, the customer may choose:

• A rescheduled reservation, subject to availability.
• Store credit that does not expire.

Weather-related cancellations are not eligible for cash or credit-card refunds.

If Hudson Kayaks determines that conditions are safe and the customer chooses not to participate because of personal weather preferences, the standard cancellation policy applies.

Activities Cut Short

Weather and river conditions may change quickly.

If Hudson Kayaks ends an activity early because of weather, safety concerns, government instructions, or circumstances beyond its reasonable control, no refund is guaranteed.

Hudson Kayaks may, at its discretion, provide a partial store credit or rescheduling option based on the amount of activity time completed and the circumstances involved.

On-site staff cannot issue refunds, store credit, or rescheduling approvals. Customers must contact the office after the activity with the reservation details.

Late Arrivals

Customers should arrive early enough to complete check-in, payment, waivers, equipment fitting, and safety instructions before the scheduled launch time.

A late arrival does not extend the reservation end time. All equipment must be returned by the original scheduled return time because it may be reserved for another customer.

Late customers may receive a shortened rental. If the delay prevents the activity from operating safely or interferes with another reservation, Hudson Kayaks may treat the reservation as a no-show.

No refund, credit, or additional paddling time is guaranteed for late arrivals.

Store Credit

Store credit:

• Does not expire.
• Has no cash value.
• Cannot be redeemed for cash.
• Cannot be used to pay gratuities, penalties, damage charges, or late fees.
• Is subject to equipment availability and current prices.
• May require the customer to pay any difference between the credit and the price of the new reservation.
• Is not refundable once used to make a new reservation.

Unless Hudson Kayaks approves otherwise, store credit is issued to the person who made the original reservation.

Refund Processing

Approved refunds are returned to the original payment method whenever possible.

Processing times are controlled partly by the payment processor and the customer's bank. Hudson Kayaks does not control how quickly a bank posts an approved refund.

Booking fees, processing fees, and service fees are not refundable unless required by law or expressly approved by Hudson Kayaks.

Participant Requirements

Customers must provide accurate information about participants, ages, experience levels, equipment needs, and any relevant limitations.

Minors must be accompanied and supervised as required by Hudson Kayaks rules. A parent or legal guardian must complete any required waiver for a minor.

Hudson Kayaks may refuse participation when a person:

• Appears intoxicated or impaired.
• Refuses to follow safety instructions.
• Cannot safely use the assigned equipment.
• Behaves aggressively or disruptively.
• Creates a risk to themselves, employees, other guests, equipment, wildlife, or the public.

A person removed or refused participation for violating safety requirements is not entitled to a refund.

Waivers and Assumption of Risk

Participation in kayaking, canoeing, paddleboarding, lessons, tours, and related waterfront activities involves inherent risks.

Every participant must complete any required waiver before receiving equipment or participating.

Refusal or failure to complete a required waiver does not entitle the customer to a refund, rescheduling, or store credit.

The waiver is separate from these Terms and remains fully applicable.

Safety Instructions and Life Jackets

Participants must follow all instructions provided by Hudson Kayaks employees, guides, instructors, park officials, law enforcement, and emergency personnel.

Participants must wear the personal flotation device supplied or approved by Hudson Kayaks at all times while launching, paddling, or near the water.

Customers may not enter restricted areas, approach prohibited structures, interfere with commercial vessels, or paddle beyond any boundaries established by Hudson Kayaks.

Equipment Responsibility

The customer is responsible for all equipment issued to the customer or the customer's group from the time it is released until it is returned and accepted by Hudson Kayaks.

Customers must return equipment on time and in substantially the same condition in which it was received, ordinary wear excepted.

Customers may be charged for:

• Lost equipment.
• Stolen equipment.
• Damage caused by misuse, negligence, intentional conduct, unauthorized transport, improper landing, contact with rocks or structures, or failure to follow instructions.
• Rescue, recovery, retrieval, cleaning, repair, or replacement expenses resulting from the customer's conduct.
• Late returns that interfere with another reservation or extend beyond operating hours.

The customer is responsible for authorized charges relating to damage, loss, recovery, or late returns. Hudson Kayaks will document the reason and amount before charging the customer, and any charge will be made only as permitted by the customer's payment authorization and applicable law.

Return Times and Late Fees

Equipment must be returned by the time shown on the reservation.

Hudson Kayaks may charge additional rental time, a late fee, employee overtime, retrieval expenses, or other reasonable costs caused by a late return, subject to the documentation and authorization requirements described in "Equipment Responsibility" above.

A customer must immediately contact Hudson Kayaks if an emergency, injury, equipment problem, or unexpected condition delays the return.

Personal Property

Hudson Kayaks is not responsible for phones, wallets, keys, clothing, vehicles, cameras, glasses, jewelry, or other personal property that is lost, stolen, damaged, dropped in the water, or left at the facility.

Customers are responsible for securing their own property and using waterproof storage when appropriate.

Photos and Media

Hudson Kayaks may take photographs or videos at its location or during activities. Any use of an identifiable participant's image will be governed by the participant's waiver, consent, or applicable law.

Park Rules and Parking

Customers must comply with all rules established by the Palisades Interstate Park Commission, parking authorities, law enforcement, and other government agencies.

Parking availability and parking fees are controlled by the applicable park or parking authority and are separate from Hudson Kayaks rental charges.

Hudson Kayaks is not responsible for parking tickets, towing, vehicle damage, park closures, traffic, or the availability of parking.

Gift Cards and Promotional Offers

Gift cards and promotional credits are not redeemable for cash except where required by law.

Promotions, contests, giveaways, discount codes, and special offers may have separate rules, deadlines, restrictions, or availability requirements.

Promotions cannot be combined unless Hudson Kayaks expressly permits it.

Website Information and Availability

Hudson Kayaks attempts to keep website information, pricing, equipment descriptions, schedules, and availability accurate. Errors may occur.

Hudson Kayaks may correct errors, change prices, update schedules, limit quantities, refuse reservations, or cancel transactions affected by incorrect information.

If Hudson Kayaks cancels a reservation solely because of its own pricing or availability error, it will refund the amount paid for that reservation.

Text Messages

Wireless carriers are not responsible for delayed or undelivered messages.

Text-message opt-in data and consent will not be shared with third parties for their own marketing or promotional purposes.

Intellectual Property

Hudson Kayaks owns or licenses the website content, logos, photographs, graphics, text, designs, and other original materials appearing on hudsonkayaks.com.

Customers may not copy, reproduce, sell, modify, publish, or commercially use Hudson Kayaks content without written permission.

Third-Party Websites

Hudson Kayaks may link to park websites, maps, payment processors, waiver providers, weather services, or other third-party resources.

Hudson Kayaks does not control and is not responsible for the content, availability, terms, or privacy practices of third-party websites.

Disclaimer

Website content is provided for general information and booking purposes. Conditions, operating hours, availability, river access, park rules, and activity schedules may change.

Hudson Kayaks does not guarantee uninterrupted website availability or that all website information will always be error-free.

Nothing in these Terms limits any right or remedy that cannot legally be limited.

Limitation of Liability

To the maximum extent permitted by law, Hudson Kayaks will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the website, a reservation, cancellation, delay, weather event, park closure, third-party service, or inability to participate.

Any limitation in these Terms is subject to applicable law and does not replace or limit the terms of any participant waiver.

Indemnification

To the extent permitted by law, a customer agrees to reimburse Hudson Kayaks for reasonable losses, claims, costs, or expenses caused by the customer's violation of these Terms, misuse of equipment, unlawful conduct, or damage caused by the customer or members of the customer's group.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Any legal proceeding relating to these Terms or the website must be brought in a court with proper jurisdiction located in New Jersey, unless applicable law requires otherwise.

Dispute Resolution

Before filing a legal claim relating to a reservation, payment, or these Terms, the customer agrees to contact Hudson Kayaks and make a good-faith effort to resolve the issue informally.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

No Waiver

Hudson Kayaks' failure to enforce any provision on one occasion does not waive its right to enforce that provision later.

Changes to These Terms

Hudson Kayaks may update these Terms from time to time. The updated version will apply to reservations made after the revised Terms are posted, unless otherwise required by law.
